Why DealPoint Solutions?

DealPoint exists to help individuals and organizations excel in making deals and settling disputes by consistently generating and keeping more value, with less friction and frustration, than they would otherwise. The firm strives to serve those who as "unlawyered" or "underlawyered" - whether due to not using lawyers enough, or at all, or due to insufficient productivity in their utilization of lawyers.

 

Some individuals and organizations may be reluctant to seek legal assistance because they perceive lawyers' fees to be excessive and unmanageable. Others may not trust the lawyers to provide the level and quality of services they need. Still others may not appreciate the potential value of effective negotiation. For many, it very well be all three.

 

DealPoint looks to the root causes. It has designed its negotiation solutions to mitigate a number of those causes:

  • underemphasis and client-disempowerment in the creation and implementation of negotiation strategy

  • open-ended and nontransparent billing, based on the quantity of billable hours reported by legal personnel

  • junior, less-experienced lawyers doing much of the heavy lifting, under an archaic apprenticeship model and clients paying for supervisory time of more senior lawyers

  • inefficiencies and delays both due to multitasking by overworked legal personnel and due to a common tendency of lawyers on both sides (and judges) to grant extensions to ease their busy schedules

Clients Take Command

DealPoint is about putting clients in charge of negotiations, whether putting together a deal or settling a dispute. In either case (deal or settlement), DealPoint solutions are available on a per-matter basis (Negotiation Envoy), a per-task basis (Negotiation Navigator) or a subscription basis (Negotiation Sherpa).

  • Per-Matter. With Negotiation Envoy a client engages DealPoint to perform a variety of tasks for a specific deal or dispute. This solution extends to formulation and management of negotiation strategy, bargaining prep, at-the-table bargaining, and agreement documentation and includes matter-specific client coaching. The key premise of Negotiation Envoy  is that a DealPoint attorney will negotiate directly with opposing counsel. Fees for this solution are fixed as follows:

    • one-time setup fee

    • a fee for each specific deliverable requested by the client, such as a strategy statement, an issue analysis, a written offer or counteroffer or a review or markup of a contract draft

    • a fee for each block of unbundled time* spent with the client or others at client request

*Unbundled time is time in excess of the blocks of time included with deliverables.

  • Per-Task. Negotiation Navigator takes an à la carte approach. With this solution, a client engages DealPoint task-by-task. These services include the same kinds of services as those provided under the Negotiation Envoy offering, but they are packaged in such a way as to support fast turnaround and cost-effective, fixed pricing, by the task. Negotiation Navigator is about enabling in-house lawyers, executives with contract responsibilities, business partners and householders can quickly turn around contract drafts, respond to claims concerning contract rights, etc. depending upon their need to offload negotiation-related work. Coaching is minimal under the basic solution. Available add-ons to this solution include coaching-type consultations on deal strategy and problem solving. The fee structure for this solution is similar to the fee structure for Negotiation Envoy 

  • Subscription. Negotiation Sherpa brings strategy, coaching and design together to help clients create and keep value in a deal or settlement. It provides a client with the assistance and tools needed to put the client in command of making a deal or settling a dispute, keeping the wheels on a negotiated relationship and getting a troubled relationship back on track. Fees for this solution are:

    • a monthly subscription fee

    • fixed fees for deliverables and unbundled time not included with the client's subscription 

Whether a client's situation calls for a per-matter, per-task or subscription solution, a DealPoint solution is designed to achieve a better, faster, easier and less costly deals by drawing from six essential skillsets:

Available Add-ons to Solutions

DealPoint complements each core solution with a variety of tools and support services as needed.

 

The core Negotiation Envoy and Negotiation Navigator solutions provide analysis, editing and drafting of proposed contract documentation, with tool-development, skill-development and various other negotiation-support services available as optional add-ons.

 

The core Negotiation Sherpa solution provides ongoing coaching to individuals in the areas described above, as applied to deals, conflicts, disputes and other challenges confronting the client from time to time, with deal-specific and settlement-specific support services such as analysis, editing and drafting and other negotiation.

 

For example, the core Sherpa coaching-centric solution includes attendance in meetings or calls with other team members or other parties, while such attendance is available as part of the coaching add-on to the core Navigator draft-review solution.
